Abstract

A tanulmány a szállítmányozási szerződés magyar szabályozásának fejlődését elemzi az 1875. évi Kereskedelmi Törvény és a hatályos Ptk. összevetésével. Bemutatja, hogy a Kt. a szállítmányozást kereskedelmi ügyletként, a ’rendes kereskedő gondossága’ mércéjére építve szabályozta, míg a Ptk. megbízási típusú, vegyes karakterű kötelemként rendezi. A vizsgálat kitér a definíciós és rendszertani különbségekre, a bizomány és fuvarozás háttérszabály-szerepére, az elévülés funkciójára, illetve a felelősségi kérdések vizsgálatára is. Mindezen kérdésekből előremutató, a szállítmányozási szerződés jelenét is érintő következtetések levonására törekszünk | The study analyzes the development of Hungarian regulations governing freight forwarding contracts by comparing the Commercial Code of 1875 and the current Civil Code. It shows that the Commercial Code regulated freight forwarding as a commercial transaction based on the standard of ‘ordinary merchant diligence,’ while the Civil Code regulates it as a mixed-type obligation of a commission nature. The study also addresses differences in definitions and systematics, the role of consignment and transportation as background rules, the function of limitation periods, and liability issues. We seek to draw forward-looking conclusions from all these issues that also affect the present state of freight forwarding contracts.
