Abstract
The order for payment procedure was introduced in Hungary by Act XIX of 1893. The fundamental purpose of this legal institution was to enable the rapid enforcement of uncontested monetary claims through non-contentious proceedings. A milestone in the applicability of the procedure was Act XXXIV of 1930 on the simplification of legislation, which partially abolished the alternative nature of the procedure by introducing a value limit and turned it into a substitute procedure. When reviewing the rules governing the procedure, one of the most important questions is whether the value limit applicable in the procedure ties the hands of those seeking justice. Are there any procedures that can be used to avoid the order for payment procedure? The question also arises as to whether there is a clear distinction between order for payment proceedings and civil litigation in the application of the law. Was/is it possible for the claimant to initiate litigation directly? Can civil proceedings initiated in this way be conducted and concluded with a decision on the merits? This paper seeks to answer these questions.
