Abstract

The study examines the regulatory history of the offence of endangering a minor, with particular regard to issues concerning the number of counts. The historical overview proceeds from the early provisions aimed at protecting children, through the former offence against youth, to the statutory definition currently in force. The study shows that, under the earlier regulation, youth as a community constituted the protected legal interest, which also affected the assessment of the number of offences. By contrast, the current regulation adopts an individualised approach and is based on the protection of the physical, intellectual, moral and emotional development of the specific minor concerned. In addition to distinguishing between the first and second basic forms of Section 208 of the Criminal Code, the study primarily analyses the issues of concurrence arising in connection with inducing a minor to commit a criminal offence. It separately examines how the subsidiarity clause operates in relation to the second basic form, and how the judicial practice developed in connection with disorderly conduct, bodily harm and criminal damage affects the assessment of this issue. The study concludes that subsidiarity should be understood as a principle for eliminating apparent ideal concurrence; accordingly, the practice preserved in Criminal Collegium Opinion No. 34 calls for reconsideration.
