Abstract

The article aims to highlight the nature and relevance of the reference to constitutional traditions in the new construction of illiberal constitutionalism in Hungary, with particular attention to the case of the constitutional jurisprudence related to it. In Hungary, the aims and effects of this reference – especially references to the achievements of the historical constitution – are to be discussed at the level of the constitutional text and with regard to the formation of new constitutional jurisprudence and, furthermore, the creation of the new constitutional identity. Remarkable theories have been developed on the elements of illiberalism or national populism in political science scholarship, and all of them emphasize the importance of the nation’s pride in its culture, history and traditions as a fundamental political aspiration. This article examines the normative legal consequences of this phenomenon in a state where this idea has consecutively won a majority in Parliament, allowing political designers to adopt and amend a constitution and to decide on the competence and composition of the Constitutional Court. The article offers a critical narrative of this constitutional concept with regard to its legal relevance that is formed significantly by the Constitutional Court.
