Abstract

Az ókori rómaiak nagy becsben tartották szentélyeiket: egyesek bőkezű ajándékokkal látták el templomaikat, mások még rabszolgáikat is odaajándékozták, annak érdekében, hogy templomőrként gondozzák azokat. Tanulmányomban Quintus Cervidius Scaevola D. 34, 1, 17. jogesetét vizsgálom, melyben a jogtudós egy szentély gondozására rendelt szolgák és az örökös jogvitájában hozott döntést. A tanulmányom módszere forráselemzés: az ókor epigráfiai leletein, papiruszain, és a római jog forrásain keresztül vázolom fel az örökhagyó, a templomőrök, és az örökös komplex jogi viszonyrendszerét. Célom e tanulmányban a jogtudósi döntés részletes elemzését elkészíteni, és indokolni a Római Birodalomban a korban fennálló jogszabályok, gyakorlatok és szokások alapján, rámutatva azokra az érvekre, amelyek Scaevola döntését alakíthatták. | The ancient Romans held their sanctuaries in high esteem: some gave generous gifts to the temples, others even donated their slaves to look after them as temple guards. In my paper, I examine the case of Quintus Cervidius Scaevola D. 34, 1, 17, in which the juristsettled a dispute between the servants assigned to the care of a temple and the heir. The method of my study is source analysis: through epigraphic finds, papyri and various sources of Roman law, I outline the complex legal relationship between the testator, the temple guardians and the heir. My aim in this paper is to provide a detailed analysis of the jurist’s decision and to justify it on the basis of existing law, practices and customs of the time in the Roman Empire, pointing out the arguments that may have shaped Scaevola’s decision.
