Abstract
This article discusses challenges of judicial independence in Hungary under illiberal constitutionalism. The main claim that illiberal constitutionalism sets up a theoretical framework and a technical toolbox against judicial independence. On the other hand, the separation of powers doctrine leads to the demand for judicial supremacy and rule of law which is part of Europe’s DNA.
