Abstract
A tulajdonhoz való jog az ókortól a középkorig státuszhoz, politikai szerephez és hierarchikus viszonyokhoz kötött jogintézmény volt, nem absztrakt alanyi jog. Funkciója a közösség, a hatalom és az öröklés rendjével függött össze. Az abszolutizmus korában a tulajdonról való gondolkodás fordulóponthoz érkezett. Megjelentek a modern természetjogi felfogások (Bodin, Grotius, Locke), míg Hobbes a jog vonatkozásában annak állami eredetét hangsúlyozta. A 18–19. század a magántulajdon alkotmányos védelme és a közérdekű korlátozások közötti egyensúlykeresés időszaka volt, ahol a liberalizmus és a kodifikáció elismerte a tulajdon társadalmi kötöttségét. A 20. században a tulajdon ideológiai kérdéssé vált: a liberalizmus alapjognak, a szocializmus és kommunizmus erősen korlátozandó, illetve felszámolandó intézménynek, a fasiszta és náci ideológia pedig sajátos politikai eszköznek tekintette. A 21. századi posztmodern felfogások a tulajdont gyakorta funkcionális, hozzáférés-alapú és globális célokhoz igazított intézménnyé igyekeznek alakítani, ami az egyéni autonómia és a jogbiztonság relativizálását veti fel. | From antiquity to the Middle Ages, the right to property was a legal institution tied to status, political roles, and hierarchical relationships, rather than an abstract individual right. Its function was inextricably linked to the order of community, power, and inheritance. During the era of absolutism, thinking regarding property reached a turning point. Modern natural law perspectives emerged (Bodin, Grotius, Locke), while Hobbes emphasised its state-originated nature in a legal context. The 18th and 19th centuries were characterised by a search for balance between the constitutional protection of private property and restrictions in the public interest, where liberalism and codification acknowledged the social obligations of ownership. In the 20th century, property became an ideological issue: liberalism viewed it as a fundamental right, socialism and communism as an institution to be strictly limited or abolished, and fascist and Nazi ideologies as a specific political tool. 21st-century postmodern approaches often seek to transform property into a functional, access-based institution aligned with global goals, which leads to the relativisation of individual autonomy and legal certainty.
