Abstract

A tanulmány a Szegedi Járásbíróságra 2022. március 1. és 2023. június 30. között érkezett, összesen 514 embercsempészéssel kapcsolatos büntetőügy iratainak vizsgálata alapján tett megállapítások bemutatására fókuszál. A tanulmányban az empirikus kutatás eredményeként levont konklúziók megértéséhez szükséges jogintézmények büntetőjog-dogmatikai szempontú elemzése is megjelenik, ennek keretében sor kerül az embercsempészés szabályozástörténeti előzményeinek bemutatásán túl a tényállásnak az elkövetési magatartás, az elkövető, a stádiumok, valamint a rendbeliség nézőpontjából történő vizsgálatára is. | The paper focuses on the presentation of the substantive criminal law findings based on the review of the file of 514 criminal cases related to human smuggling received by the Szeged District Court between 1 March 2022 and 30 June 2023. The paper also provides a criminal law-dogmatic analysis of the legal institutions necessary for understanding the conclusions drawn as a result of the empirical research, which includes an analysis of the legal history of human smuggling from the perspectives of the perpetrator’s conduct, the perpetrator and the inchoate offences.
