Abstract
The aim of this study is to examine the development of the criminal policy approach to, and the criminalization of, offences committed within the family against children and other family members in Hungary. The paper provides an overview of the relevant offences set out in the Hungarian Criminal Code and, in addition to presenting the legal framework, identifies the most common shortcomings in judicial and law enforcement practice. It also discusses the rationale behind recent legislative amendments, with particular emphasis on the influence of European Union requirements. The study highlights the significant prevalence of secondary victimization in cases of domestic violence, which indicates shortcomings in the training and preparedness of professionals involved in victim support and criminal justice processes. Furthermore, the paper examines the 2024 Directive of the European Parliament and of the Council on combating violence against women and domestic violence, emphasizing its role in strengthening measures against online violence, enhancing the protection of victims, and improving the prevention of sexual violence.
