Abstract

Magyarország EU-tagsága viszonylag hosszú időn keresztül nem vetett fel olyan jelentősebb alkotmányossági vitákat, melyekre az Alkotmánybíróságnak kellett (volna) megadnia a választ. Ebből fakadóan viszonylag későn kellett érdemi vizsgálatot folytatnia olyan kérdésekben, mint az alkotmány helye és szerepe, annak védelme, a tagállami jog, illetve a tagállami hatáskörök megítélése az uniós jog tükrében. 2016-tól kezdődően ugyanakkor „útkeresésbe” kezdett az Alkotmánybíróság, melyben megkísérelte megfogalmazni azokat a sajátos értékeket, melyeket minden mást megelőzően védelemben részesít az uniós jog, illetve hatáskörök érintettsége esetén is. Ebben az útkeresésben a külföldi minták mellett egyre növekvő szerepet játszott az Alaptörvény identitásteremtő jellege és annak révén történeti alkotmányunk vívmányainak felfedezése is. | For a relatively long time, Hungary’s membership of the EU did not raise any major constitutional disputes that the Constitutional Court had to (would have had to) answer. As a result, it was relatively late in having to examine the merits of issues such as the place and role of the Constitution, its protection, and the assessment of national law and national competences in the light of EU law. In this pathfinding process, alongside the foreign models, the identity-forming character of the Fundamental Law and, through it, the discovery of the achievements of our historical constitution, played an increasing role.
