Abstract

A Ferenc pápa pontifikátusa alatt megvalósuló kánonjogi reformok mind az egyházi bíróságot, mind annak lelkipásztori feladatait, mind pedig a család intézményét (újra) az érdeklődés középpontjába állították. E tanulmány a három fogalom metszéspontját kívánja néhány szemponttal megvilágítani. Ehhez elsőként a katolikus egyház belső jogrendszerének és a „családjog” fogalmának összeegyeztethetőségét vizsgálja meg. Rámutat az önálló „egyházi családjog” hiányának okaira, melyek részben a latin jogrend szemléletmódjára vezethetők vissza, azonban egy elkülönülő jogág hiánya külsődleges tényezőkkel is magyarázható. A tanulmány e kérdéskör bemutatása után az egyházi bíróságok mint a jogalkalmazás megkülönböztetett helyeinek szerepét járja körbe a felbomlott családok pasztorális kísérésének fényében. Kritikusan kibontja, hogy e törvényszékek milyen feladatokat képesek hatékonyan ellátni, és melyek mutatnak túl rajtuk. | The reforms of canon law under the pontificate of Pope Francis (re)focused attention on the ecclesiastical tribunal, its pastoral functions, and the family. This paper aims to shed some light on the common intersection of these three issues. At first examines the compatibility of the legal system of the Catholic Church and our concept of „family law”. The reasons for the absence of a separate legal branch can be traced to the attitude of law of the latin church, but it can also be explained by external factors. Following the examination of this question, this paper focuses on the role of ecclesiastical tribunals, considering the pastoral care for broken families. The paper takes a critical look at which tasks the courts are capable of handling effectively, and which are those that go beyond their capabilities.
