Abstract
In easy cases, the standard solutions developed in legal practice are easily applicable. Difficult cases require seeking certainties in the midst of uncertainties. In the case of a standard form, there exists a decisive rule, the application of which entails not only the sheer ap- plication of the abstract rule to the concrete facts (“subsumption”), but also requires specified or individualized application of the applicable norms.
