Abstract
The article offers an overview of the legal questions regarding the participation of linguistic minorities in the Italian parliament. Since in international minority rights law there is not any legal obligation to grant parliamentary representation for minorities, states have a large discretion in their domestic legislation on securing the right of minorities to participate in public affairs. In Italy the protection of minority rights is in the dominant part delegated to the regional and local administrative level. Regionalism also affects parliamentary representation of minorities, many linguistic minorities live in autonomous regions and in Valle d’Aosta or in Trentino-South Tyrol the preferential electoral provisions applied in these regions facilitate the election of the representatives of the French-speaking and German-speaking minorities to both chambers of the parliament. In addition to that the electoral law introduced a preferential threshold and the creation of an electoral district where the Slovene minority lives in substantial numbers, however these provisions have a minor impact on minority participation.
