Abstract

A tanulmány egy olyan örökzöld témát boncolgat, amely a hatósági eljárás tárgyi hatályának kérdésével, illetve a kivett eljárásokkal foglalkozik. Annak bemutatására vállalkozunk, hogy az évtizedek alatt miképp alakult át a kivett eljárások rendszere, miképp bővült, vagy esetleg szűkült a hatósági eljárásjog hatálya alól kivett eljárások köre. A kivett eljárások közül kiemeljük az idegenrendészeti eljárásokat, megvizsgálva, hogy indokolt-e a kivett eljárás jellege a szakigazgatási területnek. | The study examines an evergreen topic, dealing with the scope of administrative proceedings and the procedures involved. We aim to show how the system of excluded procedures has changed over the decades, how the scope of procedures excluded from the scope of administrative procedural law has expanded or, in some cases, narrowed. Among the excluded procedures, we highlight immigration procedures, examining whether the nature of the excluded procedure is justified in the field of specialized administration.
