Abstract

The enforcement of rights is a term that can be used in several different ways. The process by which the court performs legal enforcement activities can also be considered the enforcement of rights. This study analyses the process of enforcing rights from the perspective of the litigants, in connection with the support that is available to the respective parties. For the parties, the term access to law enforcement can practically be considered as equivalent to the concept of access to justice and, in part, to the right to be able to initiate legal proceedings. The enforcement of rights is a process shaped by state regulation, in particular by rules governing procedural fees, the scope of legal allowances, and the provision of legal aid (the use of an advocate). Based on the parties’ point of view and the available evidence (subsequent motions for evidence), the enforcement of rights in civil proceedings can be understood as a series of behaviours shaped by the parties’ subjective state of consciousness and their objective factual situation, that is, by the “subject” (legal subject) and the “object” (evidence). The levels of enforcement may vary depending on the intellectual and financial possibilities of the legal entity, the extent of state support, and the content of the legal regulation.
