Abstract

This paper explores the complexity of group decision-making and organizational dynamics, focusing on the dogmatic intersections between management theories and the Hungarian legal framework (specifically the Civil Code, Labor Code, and the Act on General Administrative Procedure). The study argues that while legal regulation primarily addresses formal structures, statutory powers, and the allocation of liability, the actual quality and direction of decisions are fundamentally shaped by internal group dynamics, bounded rationality, and information flow topologies. The paper provides a detailed analysis of group typologies in light of decision-making autonomy, highlighting the inherent tension between self-managing teams and the hierarchical liability models of traditional labor law. Furthermore, it maps the legal equivalents of managerial-psychological intervention techniques (such as the “devil’s advocate” method) within adversarial legal proceedings. Utilizing a Foucaultian and Habermasian theoretical framework, the study concludes that true decision-making power concentrates around actors who control organizational discourse and information topologies—a phenomenon that modern compliance frameworks increasingly seek to regulate.
