Abstract

A tanulmány a Nemzeti Kisebbségek Védelméről Szóló Keretegyezmény szerkezetét és monitoring eljárását mutatja be, ezeken keresztül pedig a roma kisebbség alapvető jogainak érvényesülését kívánja vizsgálni, elsődlegesen a Keretegyezmény Tanácsadó Bizottságának véleményein keresztül. A Nemzeti Kisebbségek Védelméről Szóló Keretegyezményt Európa legtöbb állama magára nézve kötelezőnek ismerte el, emellett pedig ciklikusan ismétlődő monitoring mechanizmussal rendelkezik, így a Keretegyezmény álláspontunk szerint alkalmas arra, hogy objektív alapot adjon az alapvető jogok érvényesülésének összevetéséhez egyes államokban. Emellett lényeges megjegyezni azt is, hogy a Nemzeti Kisebbségek Védelméről Szóló Keretegyezményének monitoring eljárásában készített vélemények jelentős hangsúlyt helyeznek a roma kisebbség helyzetére, így a roma kisebbséggel kapcsolatos összehasonlító jogi kutatásra meglátásunk szerint kifejezetten jó alapot adnak a Keretegyezmény Tanácsadó Bizottságának véleményei. | The study presents the structure and monitoring procedure of the Framework Convention for the Protection of National Minorities and,through these mechanisms, seeks to examine the realization of the fundamental rights of the Roma minority, primarily on the basis of the reports of the Advisory Committee to the Framework Convention. The Framework Convention for the Protection of National Minorities has been recognized as legally binding by the majority of European states and is accompanied by a periodically recurring monitoring mechanism. Consequently, in our view, the Framework Convention provides an appropriate and objective basis for comparing the realization of fundamental rights across different states. Furthermore, it is important to note that the reports produced within the monitoring procedure of the Framework Convention place considerable emphasis on the situation of the Roma minority. For this reason, we consider the reports of the Advisory Committee to the Framework Convention to provide a particularly suitable foundation for comparative legal research concerning the Roma minority.
